Photodigi builds fully-customisable mobile Applications for users on the third party Goodbarber platform.
These Terms of Service cover your use of and access to our website www.photodigi.com as well as your subscription to our services. The terms are applicable to each user of our website and services, and by accessing our website or services you agree to these Terms of Service. If you do not agree to all of these terms then you may not use our services.
Use of our service
Photodigi manages the app creation process on the Goodbarber platform. Photodigi is not responsible for the implementation of new features or any changes to this third party platform.
Photodigi may send you newsletters or administrative emails. This is part of your agreement to use our services.
Photodigi does not guarantee the lifespan of the provision of our services and we do not guarantee the compatibility between an application on different devices or when operating systems and/or browsers are upgraded.
In order to use our services, you agree to an account being created on your behalf, to which you will be granted access.
The information you supply to us as part of our Application creation process must be complete and accurate.
You must immediately notify us of any loss, theft or unauthorised use of your Account or Password. You are responsible for all activity on your Account.
We reserve the right to terminate our service to you, without liability to you or to any other party. This may occur at any time and without warning.
You must be over 18 years of age to use our services, or have legal parental or guardian consent. If you are under 13 years old, then you are not allowed to use this service.
The number of content sections contained with any individual application is limited to 120. This cannot be increased.
The cost of Apple and Google developer accounts is not included in the Photodigi subscription price. Developer accounts must be purchased separately by you in order to publish your native app. Your app must be published through a developer account that you own. The cost of these developer accounts is not included in our 30 day money back guarantee offer.
Photodigi does not guarantee and is not responsible for ensuring the successful approval of applications on the Apple App Store and Google Play Store. We will endeavour to work with our customers to ensure the best chance of successful submissions to the app stores.
Each user is entitled to one free rebuild and resubmission to the app stores, per app and per year. Any additional rebuilds and resubmissions are chargeable on each occasion (prices are available on www.photodigi.com).
App content and responsibilities
In order to use this service, you must own all rights in and to any content uploaded by you, including design materials, photos, videos, text, sounds and any other such content, or otherwise have (and will continue to have) the full rights, consent and authority to use the content.
By using this service, you confirm that the content uploaded by you is true, current, accurate and doesn’t infringe on any third party rights. You warrant that it is in no way unlawful for you to possess, post, transmit or display in the country in which you or your Application visitors reside.
You will abide by all applicable laws regarding the posting, transmission and publication of any personal information.
You may not post or upload via our service any defamatory, libellous, obscene, harassing, threatening, incendiary, abusive, racist, offensive, deceptive or fraudulent, content. The following content is also forbidden in your app: violence, profanity or crude humour, mature or suggestive themes, horror or fear themes, drugs, sexual content or nudity, gambling and contests, simulated gambling.
You must not use the service for any illegal purposes.
You agree to receive occasional promotional messages and materials from us.
Fees and payments
Our fees can be found at www.photodigi.com/buy.
Subscription fees are payable at the start of each relevant period and the first payment will be processed immediately.
Subscription fees may be changed at any time. We will try to give as much warning as possible of any changes. If you do not agree to such changes then you can cancel the service at any time.
The 30 day period for the money-back guarantee commences from the date you are granted access to your application’s back office.
After the 30 day money-back guarantee period, refunds are not paid upon cancellation of an account, even if the user is part-way through a subscription or renewal period at the time of cancellation.
Refunds are only issued at our discretion.
You agree to keep your payment details updated to avoid interruption to your services.
